India’s proposed Promotion and Regulation of Online Gaming Bill, 2025 seeks to create a new legal framework for the online gaming sector. The bill aims to promote certain types of games while completely banning others, with the goal of protecting consumers and aligning the industry with national interests.
Key Highlights of the Bill
The bill classifies online games into four distinct types:
- E-sports: Competitive video games played in tournaments, such as PUBG or FIFA. The government plans to promote these games as skill-based activities that can lead to career opportunities.
- Social Games: Casual games played for fun, like Ludo King or Candy Crush. While considered safe, they will still be regulated to ensure user safety, data protection, and age-appropriate access.
- Educational Games: Games designed for learning and skill-building, like Duolingo or coding apps. The bill fully supports these games for their positive impact.
- Online Money Games: Games where players deposit money for a chance to win cash prizes. The bill will completely ban these games, citing their addictive nature and potential to cause financial and psychological harm.
Why the Bill is Needed
According to the government, the rapid growth of online gaming in India has created a “regulatory grey zone,” leading to a number of serious issues. The bill is intended to address:
- Lack of Regulation: Currently, there is no single legal framework or central authority to oversee online gaming, which exposes users, especially young people, to various risks.
- Social Harm: The unregulated expansion of online money games has been linked to addiction, debt, and mental health issues.
- Economic Consequences: Unchecked growth has led to debt traps and suicides. Many of these platforms operate across borders, making them difficult to regulate.
- Public Safety: The government wants to ensure the industry’s growth aligns with public safety and ethical practices.
What is Prohibited Under the Bill?
The bill clearly states that no one can operate, assist, or promote online money games in India. The prohibition includes:
- Offering Online Money Games: Individuals, companies, or any platform are completely banned from providing these services.
- Advertising: No person or organization can create or publish advertisements—on TV, social media, or any online platform—that directly or indirectly promote money-based online games.
- Financial Transactions: Banks and payment companies are forbidden from processing or allowing any transactions related to online money games.
To enforce these rules, the Central Government will establish a new authority to issue guidelines that all gaming platforms must follow.
Penalties for Violations
The bill outlines strict penalties for those who violate its provisions:
- For Offering Online Money Games: Violators can face imprisonment for up to three years and/or a fine of up to ₹1 crore.
- For Publishing Advertisements: Anyone who creates or publishes ads for these games can be punished with imprisonment for up to two years and/or a fine of up to ₹50 lakh.
- For Processing Payments: Individuals involved in authorizing or processing payments for online money games can face imprisonment for up to three years and/or a fine of up to ₹1 crore.
